Terms and Conditions

These General Terms and Conditions (GTC) apply to all orders, purchases, and subscriptions made via the website www.drillup.io as well as the associated member area.

‍A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their self-employed professional activity.
An entrepreneur is any natural or legal person who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

With respect to entrepreneurs, these GTC shall also apply to future business relationships without the need for renewed reference. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby expressly rejected; they shall only become part of the contract if we have expressly agreed to them.

DrillUp offers exclusively digital content, in particular:
‍
- digital downloads (e.g. Project Files, Blueprints, Templates, Presets)
- access to a digital member area
- monthly provision of digital content as part of a subscription
- lifetime access to all current and future content of certain products

No physical products are shipped.

The presentation of digital products on the website does not constitute a legally binding offer, but a non-binding product overview.
By clicking the “Buy now” or “Subscribe” button, you submit a binding offer to purchase the product or conclude a subscription.
The contract is concluded as soon as the payment has been successfully completed via Stripe. Access to the digital content is granted immediately after payment.
The contract text is not stored by DrillUp.

4.1 Immediate Access
After successful payment, you receive immediate access to all purchased digital content via the DrillUp member area.

4.2 Lifetime Access
For lifetime products, customers receive permanent access to:
- all content included at the time of purchase
- all future extensions, updates, and new files added to the product

Lifetime access is non-transferable.

4.3 Subscriptions
Subscriptions include, among other things:monthly provision of new digital contentwhere applicable, monthly download limits or coinscontinuous access to the member areaSubscriptions renew automatically unless canceled by the customer in advance.

The following payment methods are available (via Stripe):
- credit card (Visa, Mastercard, etc.)
- Apple Pay
- Google Pay
- Stripe Link
- Klarna (depending on country: Sofort, direct debit, credit card)

Payment processing is handled exclusively via Stripe.

Subscriptions can be canceled by the customer at any time by following these steps:
- log in to the DrillUp member area
- click on “Manage subscription”
- you will be redirected to the Stripe customer portal
- cancel the subscription directly in the Stripe portal

After cancellation, access remains active until the end of the already paid billing period.
No refunds are provided for unused or partial periods.

As DrillUp provides exclusively digital content that is made available immediately after purchase, the right of withdrawal expires in accordance with § 356 (5) of the German Civil Code (BGB) once:
- the customer confirms at the time of purchase that performance of the contract begins immediately, and
- the customer confirms that they thereby lose their right of withdrawal.This consent is given automatically upon completion of the payment process.

Once access to the digital content has been granted, returns or refunds are excluded.

8.1 General
Upon purchase, the customer receives a non-exclusive, non-transferable license to use the content for their own social media content.

8.2 Permitted Use
- editing the project files to create your own videos
- using the content on your own social media accounts
- use for personal brands and services

8.3 Prohibited Use
- resale, redistribution, or free distribution of Project Files
- uploading the Project Files themselves (or slightly modified versions) to platforms
- selling the content as your own templates
- using the content for your own template or download shop
- publishing or sharing the files (even in part)

DrillUp strives to keep the digital content available at all times.
However, there is no entitlement to permanent or uninterrupted availability, as technical maintenance or server issues may occur.
Lifetime access is granted for the duration of the availability of the platform or the respective product.
In the event of permanent discontinuation of operations, insolvency, or force majeure, access to the content may cease.

- DrillUp does not guarantee specific results, such as reach, performance, or viral videos.
- DrillUp does not provide any financial or business success guarantees.
- In cases of slight negligence, DrillUp shall only be liable for breaches of essential contractual obligations.

To provide content and subscription functionalities, DrillUp uses the following third-party services as part of GDPR-compliant data processing:
-Make.com (automation)
- Airtable (data management, e.g. coins)
- BunnyCDN (download delivery)
- Memberstack (login & membership management)

German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the customer is a merchant, the place of jurisdiction shall be Stuttgart.
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
